Governor Healey Files Energy Affordability Legislation
Yesterday, May 13, Governor Healey filed An Act relative to energy affordability, independence, and innovation.
According to the announcement, the legislative proposal is designed to save customers money, bring more energy into Massachusetts, increase accountability of the utilities and drive innovation. NAIOP was pleased to see the Administration included language that creates processes to proactively identify and build utility infrastructure to facilitate economic development and housing, further integrating economic development needs into ongoing grid planning efforts.
“NAIOP applauds the Healey-Driscoll Administration for not only tackling energy affordability, but also establishing clean energy-ready zones, which will provide predictability and certainty for future housing and economic development projects,” said Tamara Small, CEO of NAIOP Massachusetts, The Commercial Real Estate Development Association. “Expanding access to clean energy infrastructure is a critical strategy for aligning our housing, climate and economic development goals.”
NAIOP is also grateful to the Healey-Driscoll Administration for including Section 43, which establishes eligibility criteria, standards, and rules for how electric energy costs for tenant air conditioning, heating and hot water usage may be assessed to tenants by landlords in buildings with centralized electric heat pumps or electric hot water systems.

DOER Hosting Large Building Energy Reporting Webinar for Building Owners
On Monday, May 19, the Massachusetts Department of Energy Resources (DOER) is hosting a webinar to provide a guided walkthrough of the energy reporting guidelines for the Large Building Energy Reporting Law. Attendees will learn how to obtain, report, and submit their building energy benchmarking report. The tools discussed will include ENERGY STAR Portfolio Manager and the Building Energy Analysis (BEAM) Tool. Reporting is due by June 30, 2025.
An Act Driving Clean Energy and Offshore Wind, Chapter 179 of the Acts of 2022 requires the reporting of energy use data for buildings over 20,000 square feet. The law requires electric, gas, and steam utilities to report usage data on behalf of the covered buildings. It requires building owners to report usage for delivered fuels such as oil, propane, and wood. The final regulations were released in February.
DOER plans to make time available for clarifying questions about the reporting process at the end of the presentation. Lastly, building owners will learn where to find more information and how to ask questions prior to the June 30th reporting deadline.
